U mag uw werknemers niet verbieden om deel te nemen, noch vragen om bewijs van deelname.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wel moet u evalueren welke diensten operationeel blijven en in overleg gaan met de <strong>vakbondsafgevaardigden<\/strong>.<\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><em>\u201cAnticiperen, communiceren en documenteren: drie sleutelwoorden voor werkgevers tijdens een nationale staking.\u201d<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Loon tijdens de nationale staking<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">De regels omtrent <strong>loonbetaling<\/strong> zijn duidelijk:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Werknemers die staken, <strong>hebben geen recht op loon<\/strong>.<\/li>\n\n\n\n<li>Vakbondsleden ontvangen mogelijk een <strong>stakingsvergoeding<\/strong> van hun organisatie.<\/li>\n\n\n\n<li>Werknemers die komen werken, <strong>behouden hun normale loon<\/strong>.<\/li>\n\n\n\n<li>Wie niet tijdig op het werk geraakt <strong>zonder eigen schuld<\/strong>, behoudt het <strong>gewaarborgd dagloon<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Als werknemers wel aanwezig zijn maar <strong>niet kunnen werken<\/strong> door de staking, <strong>ontvangen zij geen loon<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Let op:<\/strong> De RVA zal waarschijnlijk geen tijdelijke werkloosheidsuitkering toekennen voor deze ene actiedag.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-gebruik-van-uitzendkrachten-verboden-of-toegestaan\"><strong>Gebruik van uitzendkrachten: verboden of toegestaan?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Het is verboden om <strong>stakingen te breken<\/strong> door gebruik te maken van uitzendkrachten. U mag dus geen interims inzetten ter vervanging van stakende werknemers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wel geldt een uitzondering:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Als slechts <strong>enkele werknemers deelnemen<\/strong> en de werking van uw bedrijf <strong>niet verstoord<\/strong> wordt, kunt u <strong>interims inschakelen<\/strong>.<\/li>\n\n\n\n<li>Als de <strong>staking aanzienlijke hinder veroorzaakt<\/strong>, is <strong>interimarbeid verboden<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Documenteer steeds uw beslissingen om juridische risico\u2019s te vermijden.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-goede-praktijken-voor-werkgevers-tijdens-een-nationale-staking\"><strong>Goede praktijken voor werkgevers tijdens een nationale staking<\/strong><\/h2>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Communiceer proactief<\/strong> met uw personeel.<\/li>\n\n\n\n<li><strong>Voorzie een continu\u00efteitsplan<\/strong>.<\/li>\n\n\n\n<li><strong>Overleg met vakbonden<\/strong>.<\/li>\n\n\n\n<li><strong>Vermijd anti-syndicale maatregelen<\/strong>.<\/li>\n\n\n\n<li><strong>Raadpleeg experts<\/strong> zoals ELOYA voor juridisch advies.<\/li>\n<\/ol>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-text-align-center wp-block-paragraph\"><strong><a href=\"https:\/\/eloya.be\/nl\/contact\/\">Neem contact op met ELOYA<\/a><\/strong> voor persoonlijk advies over sociaal recht, personeelsbeheer en interne communicatie tijdens sociale acties.<\/p>\n<\/blockquote>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Recht op staking en deelname van werknemers De nationale staking valt onder het stakingsrecht, beschermd door de Belgische grondwet en rechtspraak.
